You may view and/or print pages from https://www.planet3.bike for your own personal use subject to restrictions set in these terms and conditions.
All e-bike photos and manufacturer logos displayed on our platform are the exclusive property of their respective brands. These images are used solely for illustrative and demonstration purposes. We do not claim ownership of, nor do we assert any rights to, these photos and logos. By using our platform, you acknowledge and agree that these images are protected by copyright and trademark laws, and you agree to use them in compliance with such laws.
3.1 You must not:
Republish, reproduce, redistribute, duplicate, or copy material from https://www.planet3.bike unless authorized to do so.
4. Orders and Payment
4.1 Order Acceptance
All orders placed through our website are subject to acceptance by PLANET3. We may choose to refuse any order for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.
4.2 Pricing and Payment
All prices listed on the website are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed and will be sent out in your order confirmation email. Prices include shipping and handling charges. Additional charges for shipping in the form of a zone cost may be charged at the check out – you can read more about this on our blog. PLANET3 is registered for UK and EU VAT, which means we collect VAT on your behalf and forward it to the respective countries’ tax authorities. This ensures that customers have no tax obligations after the purchase.
Payment must be received by us before our acceptance of an order. We accept various payment methods including major credit cards, debit cards, and other payment methods as indicated on our website. You represent and warrant that the payment information you provide is true, correct, and complete; you are duly authorized to use such payment method for the purchase; and you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.
5. Shipping and Delivery
5.1 Shipping Policy
We will ship the products to the address you provide at the time of purchase. It is your responsibility to ensure that the shipping address is correct and accessible. Delivery times are estimated and not guaranteed. We are not responsible for delays caused by factors beyond our control, such as weather, customs, or courier delays.
Your email and phone number are required to process and ship your order. Orders without this information will be delayed, as DHL’s system mandates both an email and phone number for shipping. During checkout, you can select your country from a dropdown menu and enter your postal code to receive the shipping cost.
As of 2023, DHL considers Israel a risk zone due to the conflict that began in 2023, resulting in an additional ‘Elevated Risk’ fee of approximately 30 EUR. Furthermore, DHL Express does not ship to individuals in the Russian Federation, only to companies or businesses.
The displayed price of the product on the PLANET3 webshop includes a 15 EUR shipping fee, which was initially the cost to ship to any EU country and the UK, effectively providing free shipping. However, due to annual price increases by DHL reflecting global shipping cost rises, additional zone costs are now included at checkout.
The guaranteed delivery deadline is 14 business days, as stated by DHL Express. Typical transit times are 1 day for the EU, 3-5 days for the USA, and 3-7 days for Australia.
For more info please visit our DHL Express blog post.
PLANET3 is registered for UK and EU VAT, which means we collect VAT on your behalf and forward it to the respective countries’ tax authorities. This ensures that customers have no tax obligations after the purchase.
While some EU countries require customs clearance, this process does not necessitate any additional fees from the customer. If and when you’re contacted by DHL customs, please don’t send them any documentation before you contact us.
For the rest of the world, import duties may apply. However, PLANET3 is declared as a 5 EUR plastic gear set or electronic controller, which in most countries falls below the de minimis value. No customer from any country has ever paid import duty for the PLANET3 device with the exception of Brazil where different rules apply due to corrupt practices of the customs agency. The remaining product value (total price minus the 5 EUR) is attributed to non-shippable customer support services, which are not subject to duties.
6. Returns and Refunds
6.1 Return Policy
If you are not completely satisfied with your purchase, you may return the item within 14 days of receipt for a refund or exchange, subject to the conditions below:
Items must be in new, unused condition with original packaging and tags.
Custom or personalized items are not eligible for return at all.
Some e-bikes are not listed on our webshop as we have not produced a compatible device. If we agree to create a prototype for you, we are not responsible if the prototype does not work, and we will not accept returns or issue refunds in this case.
All returns due to incorrect orders, damaged devices (by customer), or unmet expectations will be at your own expense.
For return address details, please contact us via email, as there are different addresses for orders from the EU and the rest of the world.
6.2 Refund Process
Refunds will be processed within 10 business days after we receive your returned item. Refunds will be credited back to the original method of payment. Please note that it may take additional time for your bank or credit card company to process and post the refund to your account.
If you provide a photo and tracking number demonstrating that the package has been sent, and do so in a civil manner, you will receive a refund immediately.
7. Warranty
The warranty against material defects and manufacturing errors on a PLANET3 mechanical unit is valid for 1 year or 10,000 kilometers and for PLANET3-E electronic device it is 2 years from the date of the original purchase and extends even to second or higher owner. Additionally, there is a 50% crash replacement discount for any accidental damage sustained through an “act of God” (e.g., flying off the trail into shrubbery and getting vegetation or surrounding geography caught between your frame and the PLANET3).
Damage sustained through the decision to have a bike mechanic install the device, or inability to follow the clear and detailed installation instructions, will be treated on a case-by-case basis. If you acknowledge your mistake and accept responsibility when parts that should not be in contact are in contact, or if you use a thicker brake rotor without consulting us, you will likely be asked to cover only the shipping cost and be sent a new unit free of charge.
However, if you publicly complain about the product being “ruined after just 5 rides” when the damage is due to your actions, we will simply point out what you did and how you caused the damage and then ignore any further attempts at communication. We are petty beyond belief.
If PLANET3 is at fault due to defects or similar issues, which is rare as every device is thoroughly tested before shipping, we will cover all costs required to correct the problem.
8. Limitation of Liability
To the maximum extent permitted by law, PLANET3 shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use our products or website, even if we have been advised of the possibility of such damages. Our total liability to you for any damages arising from or related to these terms will not exceed the amount you paid for the products or services.
PLANET3 is a device designed to remove the legally imposed assistance speed limit set for Class 1 e-bikes by the EU Regulation 168/2013 or similar regulations by your government. This modification renders the e-bike illegal to ride on public roads and surfaces. However, de-restricting an e-bike is not illegal if it is used solely on private land, and PLANET3 is sold with this intention—to be used exclusively on private property. By purchasing PLANET3, you acknowledge that PLANET3 cannot be held liable for any damage, injury, fine, or cost incurred by you, your e-bike, or anyone else as a result of your actions. You agree to take full responsibility and accept the consequences that may arise from your use of the device, without involving PLANET3.
9. Governing Law and Dispute Resolution
These terms and conditions are governed by and constructed in accordance with the laws of the jurisdiction in which PLANET3 operates, without regard to its conflict of law principles. Any dispute arising out of or related to these terms and conditions or the use of our products or website shall be resolved through binding arbitration in accordance with the rules of the District Court in Banja Luka (Bosnia & Herzegovina). The arbitration shall be conducted in the jurisdiction of PLANET3’s principal place of business, and judgment on the arbitration award may be entered in any court having jurisdiction.
10. Changes to Terms and Conditions
PLANET3 reserves the right to amend these terms and conditions at any time. Any changes will be posted on this page, and the date of the latest revision will be indicated at the top. Your continued use of our website and services after any changes constitutes your acceptance of the new terms and conditions.
11. Contact Information
If you have any questions about these terms and conditions, please contact us.
By enhancing these terms and conditions, we’ve ensured they are comprehensive and professional, covering various aspects of the business operations and customer interactions, while protecting the company and providing clarity to the users.
